3. Eligibility
Access to the Platform is limited to schools, authorised staff, students under appropriate supervision, and parents where such access has been approved by the school.
4. School Responsibilities
Schools are responsible for maintaining accurate data, obtaining the necessary permissions and consents, supervising student use, and remaining accountable for their own educational decisions.
5. Accounts and Access
You agree to provide accurate information and to maintain the confidentiality of your account credentials. Schools are responsible for managing access to the Platform within their institution.
6. Student Data and Privacy
All personal data is processed in accordance with our Privacy Policy. Schools are responsible for obtaining any parental consents required by applicable law before students use the Platform.
7. Ownership of Educational Data
Schools and students retain ownership of their educational records. Upon termination of service, options to export or delete such data will be made available in accordance with our data retention practices.
8. Intellectual Property
Kalqy retains all ownership of the Platform's software, games, and AI systems. Schools retain ownership of any materials they upload. Nothing in these Terms transfers our intellectual property rights to you.
9. Acceptable Use
You must not reverse engineer the Platform, attempt unauthorised access, upload malware, use the Platform for any unlawful purpose, or share account credentials with unauthorised persons.
10. AI-Generated Content
Certain features use artificial intelligence to assist with educational content. AI outputs are not guaranteed to be accurate, and educators should review such content before using it in the classroom.
11. Motion-Sensor Features
The Platform uses motion-sensing and computer-vision technology to support educational gameplay. Educators are responsible for ensuring a safe learning environment and that students are physically able to participate.
12. Subscription and Payment
Subscription and payment terms are governed by the specific agreement between Kalqy and the school. Unless stated otherwise, fees are non-refundable.
13. Availability
We use reasonable efforts to keep the Platform available but cannot guarantee uninterrupted or error-free access.
14. Third-Party Services
The Platform may integrate third-party services. We are not responsible for the availability, accuracy, or content of such third-party services.
15. Warranties
The Platform is provided on an "as-is" and "as-available" basis. We make no warranties regarding academic outcomes or specific results.
16. Limitation of Liability
To the maximum extent permitted by law, Kalqy's total liability arising out of or relating to these Terms shall not exceed the fees paid to us for the service giving rise to the claim.
17. Indemnification
Schools agree to indemnify and hold Kalqy harmless from claims arising out of their use of the Platform or breach of these Terms.
18. Force Majeure
Neither party shall be liable for any failure or delay in performance caused by events beyond its reasonable control.
19. Governing Law
These Terms are governed by the laws of India, and any disputes shall be subject to the jurisdiction of the courts of Alappuzha, Kerala.
